Introducing the concept "Competent Authority" (Services Directive)

Description

The Working Group suggested to introduce the concept fo "Competent Authority" which is according the Services Directive, the agent responsible for providing the service. The role of Competent Authority can be filled in by a Public Organisation or a Legal Entity.

 

Proposed solution

"isCompetentAuthority" has been added as an association between "Formal Organisation" and "Public Service", meaning that a Formal Organisation can have the role of Competent Authority and thus is responsible for the provision of that service.

Definition of Competent Authority:

"Any body or authority which has a supervisory or regulatory role in a Member State in relation to service activities, including, in particular, administrative authorities, including courts acting as such, professional bodies, and those professional associations or other professional organisations which, in the exercise of their legal autonomy, regulate in a collective manner access to service activities or the exercise thereof"
