Superclass of Person, Competent Autority and Legal Entity

Description

In the context of CPSV-AP, the following definitions apply to the classes Person, Competent Autority and Legal Entity (more elaborated descriptions are available in the specification):

  • Person: A natural person.
  • Legal Entity: A business that is legally registered.
  • Competent Autority: Any body or authority which has a supervisory or regulatory role in a Member State in relation to service activities, including, in particular, administrative authorities, including courts acting as such, professional bodies, and those professional associations or other professional organisations which, in the exercise of their legal autonomy, regulate in a collective manner access to service activities or the exercise thereof.

The definition for Competent Autority comes directly from the Service Directive.

Feedback came from the Working Group that, for instance in legislation, the concept Person is a superclass and can stand for both a Natural Person or a Legal Person (organisation). This could also be a Competent Authority. The Working Group requested to put a link to this way of interpreting the concept of Perons in the specification.

Proposed solution

A footnote has been added in the Secification to clarify the meaning of the Person class in the context of CPSV-AP:

"In the context of this specification the Person Class refers to a natural person. In some countries, for instance in legislation, the concept Person is used to referring both to a natural person (“Person” in CSPV-AP) and a Legal Person (“Legal Entity” in CPSV-AP)."
